Biography

Edward J. (Nick) Nicholas specializes in business and commercial litigation and has represented clients ranging from small privately-held companies to global corporations. Mr. Nicholas has litigation experience in the fields of business and contract disputes, bankruptcy, corporate finance and securities, intellectual property, products liability and class-actions.

Military

Before beginning his legal career, Mr. Nicholas served in the United States Navy for nine years and was stationed on the aircraft carrier U.S.S. Nimitz (CVN-68) for four years. During his time onboard the U.S.S. Nimitz, he traveled throughout Europe and the Mediterranean.

  • Represents a former Officer in an employment contract dispute.

  • Represents a National Bank in several disputes related to depository accounts.

  • Represents a global manufacturer in a case involving breach of contract allegations.

  • Represented a national lending institution in a case involving allegations of trademark infringement.

  • Represented two top-five global banking corporations in a patent infringement case related to online credit applications and chat help.

  • Represented two global manufacturers in several class actions involving alleged price fixing and other alleged violations of the Clayton and Sherman Act.

  • Represented a National Bank in a defamation case arising from allegations of self-dealing by several charitable trusts.

  • Represented a National Bank in a case involving alleged violations of the Fair Credit Reporting Act and the Fair Debt Collections Practices Act.

  • Represented two top-five global banking corporations in a patent infringement case related to the electronic imaging and transmission of transaction documents.

  • Represented a top-five global banking corporation and several nationally known insurance corporations in a case arising from the Internal Revenue Service's decision to disallow corporate tax deductions for company-owned life insurance.

  • Represented a former President and Chief Operating Officer in a Securities & Exchange Commission investigation concerning allegedly fraudulent public filings and other alleged Sarbanes-Oxley violations.

  • Represented a Fortune 200 financial services company in a dispute involving claims of wrongful foreclosure and violation of the customer's credit privacy.

  • Represented a National Bank and a Fortune 200 financing company in consumer class actions filed by two State Attorney Generals, and in numerous state court class action cases filed by private plaintiffs, regarding the financing of in-home purchases.

  • Obtained and successfully defended before the Fifth Circuit Court of Appeals the summary dismissal of two Civil RICO claims.

  • Represented a Fortune 200 corporation in several multi-jurisdictional disputes regarding the apportionment of product liability claims.

  • Represented a Fortune 300 corporation in a dispute regarding allegations that the parent company had overvalued its subsidiary's net worth at the time it was spun-off.

  • Represented a corporate debtor's former parent company in what was then the largest bankruptcy ever filed in the Eastern District of Texas.

  • Represented a manufacturing company's former parent in more than 100 product liability cases filed throughout the United States.

Organization Membership

Mr. Nicholas is Vice-President of the Katy Bar Association and a member of the American Bar Association, the Texas Bar Association, the Houston Bar Association, the Fort Bend County Bar Association, and the American Association for Justice (formerly known as the Association of Trial Lawyers of America).

Community Involvement

Mr. Nicholas is a member of the board of directors for the local Chamber of Commerce and serves as chairman of the Governmental Affairs Committee, and a member of the Business Development, Katy Rice Harvest Festival and Annual Gala Committees. He is also a member of the Fort Bend Public Policy Initiative and the Greater Houston Partnership, and serves on the Partnership's Federal Relations, State Relations and Local Relations Committees.

During law school Mr. Nicholas interned at the First Court of Appeals of Texas and worked at the 151st Judicial District Court of Harris County, Texas. He also served in student government, worked for the Civil Litigation Department, and participated in the college's Disability Clinic, which helped the indigent process their social security and Medicare claims.
