Biography

Lionel M. Schooler has developed significant expertise in labor and employment law as well as business litigation (with an emphasis in federal practice). He has also served as an arbitrator in business, health care, construction, and employment disputes, as well as a consultant to parties on arbitration matters.

Mr. Schooler has practiced law for more than thirty-five years, following his completion of a clerkship with the Honorable United States District Judge Carl O. Bue, Jr. of the United States District Court for the Southern District of Texas (Retired). His practice primarily focuses on management-side labor and employment law, which includes claims under all employment discrimination laws, wage and hour issues (such as exemptions and overtime) under the Fair Labor Standards Act, investigations by the Equal Employment Opportunity Commission, the Texas Workforce Commission and the Occupational Safety and Health Administration, ERISA litigation, litigation involving protection or exploitation of trade secrets and confidential information and intellectual property, and enforcing or challenging covenants not to compete, federal arbitrations and litigation, appellate practice, bankruptcy and complex commercial litigation, construction litigation and arbitration, banking litigation, and real estate and title insurance litigation. Mr. Schooler's practice has also included tax litigation, antitrust litigation, securities litigation, general litigation, energy litigation, oilfield property litigation, and False Claims Act litigation.

Mr. Schooler has extensive experience in arbitration as an arbitrator on the Commercial and Employment Panels of the American Arbitration Association, and as an advocate and is now a Fellow of the Chartered Institute of Arbitrators for international arbitration matters. He has tried over 50 jury and non-jury cases, and he has argued numerous appeals in the United States Court of Appeals for the Fifth Circuit and in the Texas Courts of Appeals.

Organization Membership

Mr. Schooler is a past Editor-in-Chief of the Houston Bar Association bi-monthly journal, The Houston Lawyer. He currently serves as Vice-Chair of the Houston Bar Association Labor and Employment Law Section. He also currently serves as Treasurer of the Houston Bar Association's Alternative Dispute Resolution Section, as the immediate Past Co-Chair of the Houston Bar Association's Historical Committee, and as the newly selected Chair of the Houston Bar Association's Federal Practice Section; he has previously served on the Council of the Houston Bar Association's Section of Litigation, and of the Houston Bar Association's Construction Law Section. Mr. Schooler is also a panelist on the American Arbitration Association Panel of Arbitrators for Commercial, and Employment Cases, and has completed training for service on the American Arbitration Association's Panel of Arbitrators for International Arbitration. He has been certified as a Fellow of the Chartered Institute of Arbitrators. He has also been selected as a Supporting Life Fellow of the Texas Bar Foundation.

Community Involvement

Mr. Schooler is a past member of the Board of Trustees for The Alley Theater, the Board of Trustees of the Jewish Community Center of Houston, the Board of Trustees of the American Jewish Committee, and the Executive Board of the Community Relations Committee.

In 2012, Mr. Schooler received the Justice Frank Evans Award from the State Bar's Alternative Dispute Resolution Section. He was also named a "Super Lawyer" in Employment and Labor by Thomson Reuters (2012).

Mr. Schooler is a Past Editor-In-Chief of the Houston Lawyer, the journal of the Houston Bar Association, and also served as a Past Editor of Appellate Lawyer, the monthly newsletter of the Houston Bar Association's Appellate Law Section.
