Recent Patent Cases in the Eastern District of Texas

Mobility Electronics, Inc. v. Formosa Electronics, et al. (E.D. Tex. 2005-06 [Texarkana]).
After initiating suit before the International Trade Commission, Mobility Electronics, JW's client, then brought this patent infringement and trade secrets misappropriation case against a Taiwanese manufacturer of power supplies for electronic devices. The claims were subsequently litigated in the Eastern District of Texas. In February, 2006, following a Markman hearing, the court issued a claim construction order construing the vast majority of claims in Mobility's favor. Mobility settled its claims against all five defendants on favorable terms.

E-Data Corporation v. Cinemark USA, Inc., Regal Entertainment Group, The Thomson Corporation, International Data Group, Inc., Amazon.com, Inc., Movietickets.com, Inc., Ticketmaster Corporation, Marcus Theatres Corporation, Fandango, Inc., Franklin Electronic Publishers, Inc., The New York Times Company, Hallmark Cards, Inc., American Greetings Corporation and Newsbank, Inc. (E.D. Tex. 2004-05 [Sherman]).
The plaintiff filed this lawsuit against The New York Times and International Data Group, JW's clients, and others on a patent involving systems for reproducing information in material objects at a point-of-sale location. JW obtained an order transferring the case.

Phoenix Licensing, L.L.C., et al. v. Chase Manhattan Mortgage Corp., et al. (E.D. Tex. 2007-08 [Marshall]).
JW served as co-counsel for Direct Response Corporation, Response Worldwide Insurance Company and Warner Insurance Company in defense of plaintiff's patent infringement claims concerning two patents relating to the marketing and sales of financial products. Judge Ward granted Defendants' motion to transfer the case to the District of Arizona.

Datatreasury Corp. v. Wells Fargo & Co., et al. (E.D. Tex. 2006-09 [Marshall]).
JW represented defendants HSBC North American Holdings and HSBC Bank USA, N.A. in a patent infringement case related to the electronic imaging and transmission of financial transaction documents. JW's client settled the suit on favorable terms.

Orion v. Xerox Corporation, et al. (E.D. Tex. 2007 [Tyler]).
JW represented Nordstrom, Inc., Denon Electronics USA, LLC, Kohl's Department Stores, Inc. and Walgreen Co. in this patent infringement suit. The case concerned two business methods patents, involving a computer assisted parts sales method and an electronic proposal preparation system. JW obtained a favorable settlement on behalf of all its clients.

Orion v. Costco Wholesale Corporation, et al. (E.D. Tex. 2007 [Tyler]).
JW served as counsel for Costco Wholesale Corporation in this litigation involving alleged patent infringement of two business method patents by Costco's websites. JW obtained a favorable settlement for its client.

Applied Concepts, Inc. d/b/a Stalker Radar v. MPD, Inc., et al. (E.D. Tex. 2009 [Marshall]).
JW represented the patentee in a lawsuit alleging patent infringement by the defendant's police tracking radar products. JW obtained an early, favorable settlement for its client.

Cheetah Omni LLC v. Verizon Communications Inc., et al. (E.D. Tex. 2009 [Tyler]-pending).
JW represents Grande Communications Networks, Inc. in a lawsuit alleging infringement of patents directed to star switching fabric and a switching element for use in an optical processing device.

JW represents plaintiff in this patent infringement lawsuit alleging that defendant infringes two patents relating to a two-way communications network.

Hospital Systems Corp. v. Carestream Health, Inc. et al. (E.D. Tex. 2009 [Marshall]-pending).
JW serves as counsel for ScImage and RamSoft in patent suit involving alleged infringement of patents concerning storage, retrieval, and transmission of medical images.

Affinity Labs of Texas, LLC v. Dice Electronics, LLC, et al. (E.D. Tex. 2008-2009 [Lufkin]).
This patent infringement case involves a patent directed to a system and method for connecting a portable audio player to an automobile sound system. JW obtained a favorable settlement for its client, Defendant Dice Electronics.

Applied Concepts, Inc. d/b/a Stalker Radar v. Kustom Signals, Inc. (E.D. Tex. 2008-09 [Marshall]).
JW represented the patentee in a lawsuit alleging patent infringement by the defendant's police tracking radar products. JW's client settled the suit on favorable terms.

Balthaser Online, Inc. v. Network Solutions, LLC, et al. (E.D. Tex. 2008 [Marshall]-pending).
JW is co-counsel for The Knot, Inc. in a lawsuit alleging that various web sites infringe the plaintiff's patent.

Blackboard, Inc. v. TechRadium, Inc. (E.D. Tex. 2008 [Marshall]-pending).
JW represents the defendant in this patent infringement matter relating to mass notification systems used for emergency alerts.

Datatern, Inc. v. Bank of America Corporation, et al. (E.D. Tex. 2008-2009 [Texarkana]).
This patent infringement case concerns a patent directed to a system for enabling access to a relational database. The plaintiff alleged that that the website of JW's client, QVC, website carried out the methods claimed in the patent. JW obtained a favorable settlement for its client.

JW represents the plaintiff in a patent infringement lawsuit alleging that a number of defendants infringe two patents relating to a two-way communications network.

Falcon Industries v. Leapers, Inc. (E.D. Tex. 2008 [Marshall]).
JW represents Leapers, Inc. in a patent infringement action concerning the alleged infringement of a patent directed to rail covers for firearm rail systems. JW's client settled the lawsuit on favorable terms.

Typhoon Touch Technologies, Inc., et al. v. Dell, Inc., Xplore Technologies Corporation of America, et al. (E.D. Tex. 2008-09 [Tyler]).
JW represented Xplore Technologies Corporation of America in a patent infringement action alleging that various computer products infringed two of plaintiffs' patents. JW obtained a favorable settlement for its client.

Whetstone Electronics, LLC v. Epson America, Inc. (E.D. Tex 2008 [Tyler]-pending).
JW represents Gandi Innovations in a patent infringement case involving patents relating to an apparatus that produces color documents that contain graphic images or text.

Antor Media Corp. v. Metacafe, Inc., et al. (E.D. Tex. 2007 [Marshall]-pending).
JW represents Discovery Communications, Inc. in this patent infringement lawsuit concerning a method and apparatus for transmitting information recorded on digital disks from a central server to subscribers via a high data digital telecommunications network.

Mobility Electronics, Inc. v. American Power Conversion Corp. (E.D. Tex. 2007 [Texarkana]).
Mobility Electronics, JW's client, brought this patent infringement action alleging that the defendant's products infringe seven of its patents in the Eastern District of Texas. JW also represented Mobility in a related action between the parties pending in the United States District Court of Massachusetts, American Power Conversion Corp. v. Mobility Electronics, Inc. (D. Mass. 2007-08). The cases settled on favorable terms.

NextCard, LLC v. American Express Company, Discovery Financial Services LLC, HSBC North America Holdings Inc., HSBC USA, Inc., and The PNC Financial Services Group, Inc. (E.D. Tex. 2007 [Marshall]).
JW serves as counsel for Defendants HSBC North America Holdings and HSBC USA Inc. in a patent infringement case related to online chat help and online credit card applications. JW's clients settled on favorable terms.

Phoenix IP, LLC v. Honeywell International, Inc. and Cadence Network, Inc. (E.D. Tex. 2007 [Marshall]).
JW represented defendant Cadence Network, Inc. in a patent suit alleging infringement of a patent directed to a computer-based system for generating customized proposals relating to consumption and cost of utilities. The plaintiff's claims against JW's client were resolved favorably.

Robert Styczynski v. Warnaco Swimwear Inc., et al. (E.D. Tex. 2007 [Tyler]-pending).
JW represents defendants Doug Bailey and Unlimited 3D Design, Inc. in patent infringement lawsuit concerning a method of molding and curing silicone onto fabric such as swimwear.

Joint Marketing International, Inc. and Kun S. Chang v. Walgreen Co., et al. (E.D. Tex. 2006-08 [Tyler]).
JW served as lead counsel for QVC, Inc. in this patent infringement lawsuit concerning a device that cleans eyeglasses. The matter settled on favorable terms.

Kawasaki Heavy Industries Ltd v. Bombardier Recreational Products, Inc., et al. (E.D. Tex. 2006-08 [Texarkana]).
JW represented Bombardier Recreational Products, Inc. in litigation involving alleged patent infringement of three personal watercraft technology patents assigned to Kawasaki Heavy Industries Ltd. JW's client obtained a favorable settlement.

Wavefront Energy and Environmental, Inc. v. Applied Seismic Research Corporation (E.D. Tex. 2006 [Tyler]).
Wavefront sued ASR, JW's client, for declaratory judgment of noninfringement, invalidity, and unenforceability of three of ASR's patents, and for tortious interference and defamation. ASR counterclaimed for patent infringement and tortious interference. The technology concerned tools to stimulate oil well production in mature oil fields. After initial discovery, the case settled with Wavefront dismissing the lawsuit with prejudice, ASR representing the primary application of its tools is to use a shockwave in wells and is not intended to inject fluid into a geological formation, and Wavefront acknowledging that leakage of fluid will occur which will need to be replaced.

Digital Choice of Texas, LLC v. Sichuan Changhong Electric Co., Orient Power Video Manufacturing, Ltd. d/b/a Oritron, Philips Electronics North America Corp., Toshiba Am. Consumer Prods., LLC, Amphion Media Works, Inc., Apex Digital, Inc., Audiovox Electronics Corp., Coby Electronics Corp., Cyberhome Entertainment, Inc., Daewoo Electronics Corp. of America, Denson Electronics USA, LLC, Desay A&V (USA), Inc., Hitachi Am., Ltd., Initial Technology Inc., J.S.
