Jackson Walker Secures Appeals Court Victory for Client in Defamation Case
Jackson Walker L.L.P. recently obtained a victory for its clients in a case involving a lawsuit brought by an Associate Pastor of a church against the church's former Pastor, Deacons and three members of the congregation.
The Associate Pastor sued Jackson Walker's clients for various causes of action, including defamation. In the trial court, Jackson Walker successfully argued that the ecclesiastical abstention doctrine and ministerial exception barred claims against its clients because the claims essentially arose out of the Associate Pastor's employment as a minister of the church. The trial court ruled that it had no jurisdiction to hear the case. The 13th Court of Appeals affirmed the trial court's ruling and the Texas Supreme Court denied the Associate Pastor's Petition for Review.
