If, after April 1, 2020, an employee has worked fewer than 30 calendar days and needs Emergency FMLA leave, but subsequently reaches the 30 day mark, does the employee then become eligible for Emergency FMLA leave?
Yes. See DOL Guidelines #14, 38. The Guidelines provide the following example, “For example, if your employee requests expanded family and medical leave on April 10, 2020, he or she must have been your employee since March 11, 2020.”
