Jackson Walker Wins Appellate Victory for Client in Partnership Dispute

Jackson Walker won a victory for its client Scott Felder on Jan. 22, 2014, when the Texas Fourth Court of Appeals in San Antonio upheld a take-nothing verdict, affirmed summary judgments obtained in his favor, and affirmed his right to recover attorneys’ fees.

The case concerned a highly contested dispute between two limited partners arising from the management and sale of millions of dollars in partnership property.

The original lawsuit, which was also decided in Mr. Felder’s favor after a weeklong jury trial, involved numerous allegations of breach of fiduciary duty brought by a limited partner against Mr. Felder, who was also a limited partner and sole director of the general partnership at issue. On March 9, 2012, the jury returned a verdict in favor of Mr. Felder and the partnership, and the plaintiff received no judgment against them.

In the appeal, Mr. Felder was represented by Jackson Walker partner Chris Mugica, who worked closely with the partnership’s counsel, David Montpas and Kevin Young of Prichard Hawkins McFarland & Young, LLP. In the trial court proceedings, Jackson Walker partners Chris Mugica and Al Kainz served as lead counsel, with Kimberly Gdula, Jorge Padilla, and Chad Smith supporting the trial team.
