Ben Rhem, an associate in the Austin environmental & legislative practice group, presented “Interstate Determination under the Natural Gas Act and Interstate Commerce Act” at the 2016 Pipeline Safety Conference in New Orleans on August 8-12.

In his presentation, Ben explains how Federal Energy Regulatory Commission‘s (FERC) determination of whether a pipeline is considered interstate or intrastate directly impacts pipeline safety obligations.  This presentation explores the factors FERC considers when determining whether a pipeline is interstate or intrastate under the Interstate Commerce Act and Natural Gas Act and how that determination affects whether a pipeline is subject to state or federal safety requirements.
