Organized in a Q&A format, Retta and Devanshi’s chapter focuses on preliminary civil procedure issues to be considered, the commencement of proceedings and defense of claims, understanding the duties and powers of the courts, and the handling of various civil procedure matters such as joinder, consolidation, evidence requirements, judgments, and settlements. The chapter also answers general questions on topics in alternative dispute resolution, including methods, limitations, and ADR institutions.

Dallas partner Retta A. Miller has over thirty years of experience in civil litigation, arbitration, and appeals. Having served as lead counsel in trials and arbitrations, Retta has developed considerable experience representing clients in a vast range of industries, including financial institutions, insurance companies, and retail brokerage firms. She has also represented clients in courts in Texas and across the United States as well as in arbitration proceedings before the FINRA, NASD, NYSE, and AAA. Dallas associate Devanshi Somaya is a litigation attorney who represents clients in cases involving breach of contract, fraud, negligent misrepresentation, and copyright infringement. Before joining Jackson Walker, she served as an extern for Justice Lang-Miers of the Fifth Court of Appeals and as a legal research, writing, and advocacy teaching assistant at the Southern Methodist University Dedman School of Law. Devanshi currently serves as a co-chair of the Dallas Association of Young Lawyers’ Equal Access to Justice Committee.
