Biography

Pete Broderick has built an extensive and diverse commercial real estate practice.

In leasing matters, he represents landlords and tenants of commercial properties of all kinds, with a particular emphasis on retail and office leasing.

He has significant experience assisting both private and municipal clients in public–private partnerships with a focus on real estate development, economic development, and land use planning projects.

Pete also represents clients in other traditional real estate matters including the purchase and sale of income-producing properties and the financing and development of all types of commercial real estate projects.

In retail leasing, Pete is well versed in addressing the challenges and intricacies of mixed-use projects in addition to having experience with mall and large lifestyle center leases.

He has experience negotiating entitlements and land use controls applicable to large development projects, and he negotiates economic development incentives for projects ranging from hotels and conference centers to automobile assembly plants, and corporate manufacturing, distribution, and headquarters facilities.

Leasing

Nationwide Retail Store and Distribution Center Leases

  • Representation of a national retailer in connection with store and distribution center leases nationwide including retail leases in malls, power centers, and mixed-use projects.
  • Representation of a publicly traded regional retailer in all real estate matters, including permanent financing of an office/distribution center, negotiation of new lease agreements and developing and implementing exit strategies for stores in abandoned markets.

Office Leases

  • Representation of landlord and tenants in large office leases, including a tenant of premises in excess of 120,000 square feet and another tenant occupying in excess of 80,000 square feet.

Distribution Facilities

  • Representation of tenants in the leasing of industrial facilities ranging in size from 60,000 square feet to over 200,000 square feet

Economic Development

Automotive Assembly Plant

  • Representation of the City of San Antonio in an Economic Development Project, which culminated in the selection of the City by Toyota Motor Manufacturing North America as the location of a large automotive assembly plant, including negotiating the Incentives Agreement on behalf of the City of San Antonio, as well as acquiring a project site covering an area in excess of four square miles.

Hotel/Convention Center

  • Representation of the City of San Marcos in connection with a public-private partnership for the development of a 250-room hotel and adjacent 80,000 square foot conference facility.
  • Representation of a municipality in negotiating and structuring a Development Agreement and a corresponding Chapter 380 Economic Development Agreement relating to the development of an upscale super regional shopping center on approximately 116 acres of land.

Corporate Headquarters

  • Representation of a company in connection with the relocation of its corporate headquarters facility including the negotiation of job creation and retention grants.

Manufacturing and Distribution Facilities

  • Representation of a multi-national food company in connection with incentives granted to locate a large scale manufacturing and distribution facility
  • Representation of an optical manufacturing company in obtaining economic incentives pertaining to the location of its manufacturing and distribution facilities

Public/Private Partnerships

Downtown Development

  • Representation of a large regional Bank in connection with a public-private partnership that resulted in the sale of the Bank’s existing headquarters tower in downtown San Antonio to the City of San Antonio, the construction of the first new high rise office building in downtown San Antonio in almost 30 years which will be the bank’s new headquarters, and the lease back of the existing tower from the City pending completion of the new tower.

Performing Arts Center

  • Representation of the City of Austin in the leasing of the Palmer Auditorium, the antiquated and under-utilized municipal auditorium, to a consortium of local arts groups to facilitate the conversion of the auditorium into the Long Center for the Performing Arts, a $110 million state-of-the-art performing arts center.

Train Station Conversion

  • Representation of a developer in connection with a public/private partnership for the conversion of an underutilized historic train station and adjacent land into a mixed use project including a hotel and restaurant/entertainment complex.

Land Use/Development Agreements

  • Representation of the City of Austin in the settlement of land use litigation regarding 3,000+ acres over the Edwards Aquifer Recharge Zone. The settlement involved the use of restrictive covenants, private agreements and innovative conservation easements to effectuate a private regulatory scheme governing land use should the Legislature ever revoke the municipality’s regulatory authority over the property.
  • Representation of the City of Austin in a Land Use Development Agreement with multiple developers governing the development of over 4,000 acres of environmentally sensitive land in the Lake Austin area.
  • Representation of the City of Austin in a Land Use Development Agreement governing the development of over 1,200 acres of environmentally sensitive land in the Barton Creek watershed.

  • Representation of a utility company in the acquisition of two existing downtown high rise buildings located on the banks of the San Antonio river which will be converted into the company’s new headquarters.
