The article, "Private Investment in Eagle Ford Shale: Use Caution," gives insight from attorneys, advisors, researchers, and brokers who know the industry the best — and know that for every five good investments, there are at least two or three investment pitfalls out there.
"A solicitation on the Internet is often quite concerning because the solicitation violates the securities laws by being a general solicitation, which is not permitted without a public registration," Ms. Chandler said. "Make sure that you run credit reports and Dun & Bradstreet reports on each principal and consider running a litigation search to gauge whether other deals have gone bad, review all of the formation documents and the agreements related to what exactly you are going to get in return for your investment, and call references who have been involved with the principals of the organization in other business dealings."
Mr. Hosey also urges investors to conduct due diligence.
"To avoid the mistakes of the past, lenders getting into the oil-and-gas field absolutely must focus on accurately assessing, and avoiding, risk," Mr. Hosey told the journal. "It's all about economics — cost-leasehold, drilling completion and infrastructure facility construction versus income from production."

Ms. Chandler's practice emphasizes securities transactions, reporting and compliance; mergers and acquisitions; technology licensing and commercialization, and general corporate work. She assists clients with both the formation of organizations, public and private offering of securities, governance issues and shareholder proxy contests, as well as Securities Act and Exchange Act compliance matters. Her clients include startup companies commercializing innovations in information technology and biotechnology; private investors and private equity and venture capital firms; and large privately held and publicly traded companies. Industries she serves include software, health care and life sciences, oil and gas, energy trading, transportation and logistics, educational institutions, and construction.
Mr. Hosey practices in the areas of oil, gas and mineral law, title and transactional matters, real estate law, business law, and international business law. Since 1998, he has served on the Joint Editorial Board for the development of the Texas Title Examinations Standards established by the Real Property, Probate and Trust Law and Oil, Gas and Energy Resources Law Sections of the State Bar of Texas, which are published in the Texas Property Code and is also a member of the Council of the State Bar Oil, Gas & Energy Resources Section. He is a frequent lecturer and writer on oil, gas and land title issues. Mr. Hosey received his B.A. degree from The University of Texas at El Paso in 1976, and is a 1979 graduate of St. Mary's University School of Law, where he is an Adjunct Professor of Law, teaching Texas Land Titles.
