Biography

Mr. Rourk has extensive experience in helping clients protect their intellectual property in the semiconductor, software and telecom fields. He has prepared and filed more than 400 patent applications, has prosecuted in excess of 200 patents to issuance, and manages client domestic and international patent portfolios. He has also assisted with numerous intellectual property transactional matters, including licensing, mergers and acquisitions, funding transactions, and joint ventures. Mr. Rourk's experience includes preparing and responding to cease and desist letters, preparing non-infringement and invalidity opinions, and assisting with patent infringement litigation in the software, semiconductor and telecom fields.

Mr. Rourk is a Registered Professional Engineer in the State of Florida and an inventor on several patents.

  • Represented a developer of image data compression technology in licensing and litigation which resulted in significant revenue.
  
  
  • Represented one of the largest semiconductor memory chip manufacturers in a patent infringement case involving DRAM, SRAM and flash memory technology that led to a take-nothing jury verdict in New Jersey.
  
  
  • Represented a large electrical equipment manufacturer in patent and trade secret litigation involving power transformer technology that resulted in a favorable settlement for less than ten percent of the claimed damages.
  
  
  • Represented a large electronic payment processor in a patent infringement case involving credit card payment technology that resulted in a favorable settlement for less than ten percent of the claimed damages.
  
  
  • Represented a polymer lining manufacturer in a patent infringement case involving extruded plastics technology that resulted in a favorable settlement.
  
  
  • Prosecuted to issuance patents that were successfully asserted against infringers in the area of data messaging technology to generate significant settlement revenue.

  • Represented a software developer and marketer in a trademark infringement and unfair competition case involving misrepresentation by a third party of which company originally developed features of a software package that resulted in a favorable settlement.
  
  
  • Represented a food manufacturer in a trademark infringement case that resulted in a favorable settlement.
  
  
  • Represented a pet charity in a trademark infringement appeal, including briefing and presentation of arguments to the United States Court of Appeals, Fifth Circuit.

Organization Membership

Mr. Rourk is a member of the Dallas Bar Association, the State Bar of Texas and has been appointed to the State Board of Examiners for Speech - Speech-Language Pathology and Audiology.

Community Involvement

Mr. Rourk is President of the Japan-America Society of Dallas/Fort Worth for the 2008-2009 term. He served as General Counsel for the Japan-America Society from 2002-2004. He has also served as an appointed member of the One Call Board of Texas.

Mr. Rourk has presented "RFID Patent Wars" to the IEEE (Institute for Electrical and Electronics Engineers) Dallas Section Meeting in November 2005. His publications include A Review of Lightning-Related Operating Events at Nuclear Power Plants, 9 IEEE Transactions on Energy Conversation 636, September 1994 and "Don't Let Your Guard Slip Over IP Ownership," Dallas Business Journal, March 1, 2002. Mr. Rourk has also published several Regulatory Analyses.
