Patrick T. Sharkey

Biography

Patrick T. Sharkey has over 35 years of experience as a commercial real estate attorney representing sophisticated clients in a diverse and dynamic blend of real estate transactions. Client engagements include the representation of landlords and tenants in office, industrial and retail leasing. His expertise also encompasses specialty leases, including hospital leases, ground leases for medical office buildings, ground leases for automobile dealerships, and manufactured housing leases (Eagle Ford Shale employee housing). In addition, Mr. Sharkey has extensive experience in acquisitions and dispositions of office buildings, industrial centers, health care properties and undeveloped land, condominium conversions and development of health care campuses. His practice also includes representing clients in intricate land transactions, land donation in lieu of condemnation and property tax appeals. He is dedicated to providing his clients with superlative service and results-oriented legal representation, acting as a guide through the often intricate maze of legal and business issues his clients face.

Mr. Sharkey is Board Certified in Commercial Real Estate by the Texas Board of Legal Specialization.

Representative Matters

  • Among numerous closings on land, office buildings, apartments, asset sales, and real estate financing transactions, several recent transactions epitomize Mr. Sharkey's dedication to attaining his clients' business objectives:

  • March 2012. Negotiated a full floor office lease in a Houston CBD building on behalf of the client/landlord for use by a railroad company's legal department.

  • March 2012. Drafted a Road Construction and Cost Sharing Agreement on behalf of a health care client. The Agreement called for the adjacent property owner to design and construct a road connecting the adjacent owner's land and the client's health care facility to the municipality's main road in return for the client's sharing the costs of the road construction.

  • February 2012. A sophisticated real estate client with a large land parcel closed on its donation of a substantial strip of land to Harris County to expedite the Texas Department of Transportation's construction of a major thoroughfare through the property. The Settlement Agreement and Land Donation Agreement was negotiated in lieu of condemnation of the land. The tension in the transaction centered on the availability of meaningful remedies if the thoroughfare's funding ceased prior to completion of the thoroughfare's construction, or the roadway was not constructed in accordance with the approved plans. Creative concepts coupled with flexibility on both sides' part resulted in a donation of land which epitomizes a "win/win" transaction.

  • January 2012. A client which owned a large number of fast food restaurants closed on the disposition of all its restaurant properties. The transaction involved the conveyance of fee simple title to multiple tracts and Ground Lease estates to other tracts of land. The closing at the end of January marked the end of the client's 30-year involvement in owning and operating over 30 fast food restaurants throughout the Houston metropolitan area.
