Does an employee’s “regular rate” include an employee’s shift differential?
The DOL’s guidelines refer to the definitions of the Fair Labor Standards Act in determining the employee’s regular pay. Shift differentials should be included as part of the regular rate when calculating overtime, and, therefore, would be included in the computation of the regular rate for purposes of the FFCRA.
