If an eligible employee takes five weeks of expanded family and medical leave to care for the employee’s son or daughter whose school is closed because of COVID-19, how many weeks of unpaid FMLA could the employee take due to the employee’s own serious health condition? (29 CFR 826.70)

Expanded family and medical leave is a type of FMLA leave. Therefore, the employee could take up to seven workweeks of unpaid FMLA leave for the applicable twelve-month period.
