Appeals Court Upholds Summary Judgment for Jackson Walker Client

Jackson Walker L.L.P. won a victory for its client when the Texas Third District Court of Appeals in Austin affirmed the trial court’s summary judgment in favor of the Beacon Ridge Townhomes Condominium Association of Owners, Inc. and property manager Debra D. Mathis.

In 2010, Jackson Walker successfully defended the Association against a lawsuit involving liens that it had imposed upon a developer for unpaid assessments. The plaintiff sought declaratory relief alleging that the liens were fraudulent and bringing claims of breach of contract. After hearing cross-motions for summary judgment, the Court ruled in favor of Jackson Walker’s client, resulting in the dismissal of all claims and the recovery of unpaid fees, interest, penalties, and attorney fees.

In its opinion issued on Aug. 7, 2013, the Third Court of Appeals affirmed the trial court’s summary judgment. Jackson Walker partner Chris Mugica and associate Kimberly Gdula represented the Association in the case and on appeal.
