Jackson Walker Secures Dismissal for ExxonMobil Chemical Company

Jackson Walker successfully defended ExxonMobil Chemical Company (Exxon) against an injunction sought in federal court in Houston.

The plaintiff, with which Exxon has an agreement requiring arbitration of workplace complaints, claimed to have no knowledge that Exxon had begun assigning newly trained employees to specific tasks in the workplace and sent a grievance about the practice to arbitration. While arbitration was pending, the plaintiff also filed a complaint in the U.S. District Court for the Southern District of Texas requesting an injunction against the company to keep it from continuing the complained-of practice.

Exxon moved to dismiss the complaint for lack of subject matter jurisdiction because the plaintiff failed to state a valid exception to the anti-injunction provisions contained in the National Labor Relations Act. The Court granted the motion in February, and the plaintiff declined to appeal the decision.
