Biography

Ali Andrews is an experienced Tax attorney with a primary focus on handling state and local tax disputes, from audits and administrative proceedings to litigation in district courts, appellate courts, and the Texas Supreme Court. She also assists clients with state and local tax planning and compliance in areas that include sales and use taxes, franchise taxes, property taxes (including Chapter 312, 380, 381 and JETI abatement agreements), unemployment taxes, mixed beverage taxes, and hotel occupancy taxes. Ali also provides litigation expertise in other areas of business, administrative, and regulatory law, having successfully litigated cases involving a broad range of topics including free speech, equal protection, open courts, sovereign immunity, administrative remedies, discovery disputes, trial procedure, and agency rulemaking.

Prior to joining Jackson Walker, Ali served as Chief of the Tax Litigation Division of the Office of the Texas Attorney General. In this role, Ali oversaw all litigation related to state taxes and unemployment issues for the State of Texas. She provided counsel to the Comptroller of Public Accounts and the Texas Workforce Commission on a wide range of matters, including litigation strategies, policy development, rulemaking, and legislation. Additionally, Ali represented the State of Texas in negotiations and interactions with other states.

Representative cases include:

  • Harris County Appraisal District v. Texas Workforce Commission, 519 S.W.3d 113 (Tex. 2017). Successfully argued before the Texas Supreme Court that the appraisal district exercised sufficient direction and control over the members of the Appraisal Review Board for the members to be considered employees of the district.
  • Best Buy Stores, Inc., through Denucci, et al. v. Hegar, et al., 03-19-00246-CV, 2021 WL 1432313 (Tex. App.–Austin April 16, 2021, pet. denied) (mem. op.). Prevented a class action sales tax refund suit that would have returned over $9 million in sales taxes to a few assignees rather than the customers who paid the taxes.
  • Citgo Petroleum Corp. v. Hegar, et al., 636 S.W.3d 281 (Tex. App.–Austin 2021, pet. denied); Conagra Foods v. Hegar et al., 03-21-0011-CV (pet. denied).. Successfully defended against approximately $25 million in claims that plaintiffs treated sales of commodities futures contracts as inventory for federal income tax purposes and are therefore entitled to certain franchise tax privileges.
  • Hegar, et al., v. EBS Solutions, Inc., 549 S.W.3d 849 (Tex. App.–Austin 2021), rev’d on other grounds. Defended the statutory scheme authorizing tax suits against constitutional challenges. Going en banc sua sponte for the first time in over a decade, the Third Court resolved conflicting case law and confirmed the unavailability of alternate remedies.

Ali Andrews Expands Jackson Walker’s Tax Practice in Austin

Jackson Walker is pleased to announce the addition of Ali Andrews as senior counsel in the Austin Tax practice. Joining from an international firm, Ali concentrates her practice on handling state and local tax disputes, state tax audits, unemployment tax matters, equal taxation, multi-state tax planning, and other administrative law matters.
