Biography
Andy Keetch is a partner in Jackson Walkerâs Fort Worth office and a seasoned construction and commercial litigator with more than 30 years of experience. He represents owners, design professionals, general contractors, EPC contractors, developers, subcontractors, manufacturers, and public entities in high-stakes construction disputes and complex commercial litigation across the United States.
Andy brings a distinctive advantage to his clients: decades of experience on every side of a construction project. Unlike attorneys who specialize in representing only one segment of the industry, Andy has counseled owners, contractors, architects and engineers, subcontractors, and developersâgiving him deep insight into the pressure points, motivations, and risk profiles that drive resolution. His practice spans the full lifecycle of a construction project, from drafting and negotiating contracts through resolving disputes in state and federal courts and arbitration forums nationwide.
Clients value Andyâs ability to simplify complex problems and deliver concrete, actionable guidance for decision-makers. He has litigated and handled construction and engineering disputes in Texas, New Mexico, Colorado, South Carolina, California, Indiana, Kentucky, Louisiana, Oklahoma, Nevada, and Arizona, and he regularly represents national and international clients.

Construction Law & EPC Contracts
Andy drafts, negotiates, and advises on construction contracts for projects ranging from $5 million high-end residential builds to EPC/EPCM projects valued well in excess of $300 million. He works extensively with AIA and DBIA contract forms and has significant experience with bespoke EPC/EPCM agreements for Texas Gulf Coast refineries, mining operations, and energy transmission projects.
His transactional practice encompasses all critical contract provisions, including liquidated damages, performance guarantees, force majeure, delay and disruption, change order management, insurance requirements, and surety provisions. Sectors served include energy, infrastructure, industrial, commercial real estate, and manufacturing.
Construction Litigation & Dispute Resolution
Andy handles the full spectrum of construction disputesâdelay claims, defect claims, mechanicâs lien enforcement, bond claims, design professional liability, owner/contractor disputes, and subcontractor disputesâwith particular depth in design professional liability and owner/contractor matters. He has served as lead trial counsel through numerous trials to verdict and arbitrations through final award, with many more matters resolved through summary judgment in favor of his clients.
Andy is frequently involved in AAA arbitrations and has significant experience managing multi-party âmegaâ construction disputes involving complex phasing and values exceeding $50 million. His strategic approach to dispute resolution emphasizes rigorous early case assessment, with tailored recommendations on mediation, arbitration, or litigation based on the specifics of each matter.

Beyond construction, Andy represents clients in breach of contract disputes, partnership and business divorce proceedings, fraud claims, real estate disputes, insurance coverage matters, and professional liability defense. He also maintains an active appellate practice, with significant wins in both Texas state appellate courts and federal appellate courts.
Construction
- Represented a major international engineering firm in relation to an EPC contract for a large refinery project
- Represented a leading food manufacturer in facility construction and expansion across multiple states, with total contract values exceeding $200 million
- Represented a state transportation agency in a $167 million railway project and related $97 million acquisition of railway assets
- Represented an A/E firm in two federal arbitrations arising from a $300+ million design-build project for the federal government; both resolved favorably for the client
- Obtained summary judgment and full recovery of fees and costs for an A/E firm in a $30 million design defect dispute, with results affirmed on appeal
- Represented an A/E firm in a multiple-fatality case in Texas state court, resulting in summary judgment and establishing black-letter law on the scope of duty for A/E firms in Texas
- Represented a building owner against a general contractor and subcontractors in a construction defect case, resulting in the construction team performing $6 million of repairs at no cost to the owner
- Represented an owner in AAA arbitration against a general contractorâs change order claims, resulting in owner recovery of damages and fees
- Represented a leading manufacturer in a construction defect case against a contractor, resulting in the ownerâs recovery of $1.25 million in consequential damages
Commercial Litigation
- Represented an international manufacturer in a dispute with a Texas vendor; successfully removed the case to federal court and obtained dismissal of vendor claims under Rule 12(b)
- Represented a commercial landlord in a lease dispute, resulting in a final verdict for the landlord
- Represented a developer in a business divorce, resulting in termination of the business entity and favorable resolution of assets

Understanding “Action Over” Claims and Third-Party Over Indemnity

An âaction overâ (also called a âthird-party over actionâ) is a type of legal action (lawsuit or arbitration) in which an injured employee, after collecting workersâ compensation benefits from his employer, files a tort claim against a third-party whose negligence allegedly caused the employeeâs injury.
