Biography

Jenny Roan Forgey is an attorney in the Land Use and Real Estate sections of Jackson Walker’s Austin Office. Jenny represents developers, owners, buyers, sellers, and investors in an array of commercial and residential real estate transactions, including acquisitions, dispositions, development, entitlement, and governance in all asset classes. Specializing in intricate real estate transactions, Jenny focuses on the development of residential and commercial mixed-use communities and governance design for complex master-planned communities. Jenny’s guidance is sought after for drafting planned community governance documents across various residential and commercial product types, including both commercial and residential condominium regimes. Her creative approach to the obstacles developers face when entitling and platting property has made her a sought-after addition to the team involved in developing a project, whether it be on a small or large scale.

In addition to her proficiency in sophisticated development plans, Jenny manages traditional commercial and residential acquisitions and sales. From the sale and purchase of developed commercial properties such as apartment buildings, data centers, warehouse/flex space, and retail developments, to the sale, purchase, and development of raw land, Jenny helps clients efficiently diligence, close, entitle and encumber real property to realize developments and enhance communities all over Texas.

As a member of the firm’s portfolio acquisitions practice, Jenny also assists in the representation of global private equity firms in the acquisition of large scale commercial real estate portfolios. Jenny’s development experience leads her to have a practical, curative approach to diligence of portfolio properties with an emphasis on national title, survey, and zoning diligence analysis.

As a member of the firm’s data center practice, Jenny brings her creative, practical approach to data center development. Understanding the unique challenges data center developers face – from timing to regulatory matters to lender concerns – makes Jenny a valuable member of a data center team. Her data center clients have come to lean on her as more than just an attorney but as a partner in bringing their developments to market.

  • Represent an international data center developer with acquisition and title curative matters pursuant to Texas law; represented that developer before local special district boards to clear or revise encumbrances on land slated for data center delivery and to help facilitate local relationships throughout Texas.
  • Represent national, public homebuilder to draft and negotiate raw land contracts, lot contracts, land banking documents, license agreements, letter of intent, and other documents needed to facilitate fast-paced acquisition and development of residential master-planned communities.

  • Diligenced over 25 master-planned communities in conjunction with a private homebuilder’s purchase of a small, regional homebuilder in Texas.
  • Managed a $1 billion refinance on behalf of a quasi-public entity that owned the key asset in the then-largest P3 water infrastructure project in the nation.
