Biography
Lynn Sherman is a partner in the Environmental, Regulatory, & Legislative practice group in Jackson Walkerâs Austin office. Lynn has over three decades of experience in addressing and resolving complex water-related challenges. His practice spans every corner of the state, encompassing every river basin, major aquifer, and most minor aquifers.
Through his diverse roles as a lawyer, consultant, executive, and thought leader, he has shaped the landscape of water policy, development, and conservation in Texas. Lynnâs expertise is particularly evident in his involvement with major water projects across Texas. He has played a pivotal role in the development of three of the longest water pipeline projects, the negotiation of two of the largest water sales agreements, and the completion of two of the largest water rights purchases, among numerous other public and private water initiatives.
Lynnâs leadership extends into the public sector, where he has served as an executive for the stateâs largest river authority, as well as in the private sector, where he has led initiatives to develop water projects with private capital. Lynn has contributed significantly to the discourse on water issues, co-authoring many authoritative works that have advanced knowledge and understanding of Texasâ water challenges, including the seminal law review article on the Rule of Capture in Texas. His work has provided actionable solutions to some of the stateâs most pressing water issues.

Texas Supreme Court Clarifies Default Ownership of Produced Water in Oil & Gas Leases â Key Questions Remain

On June 27, 2025, the Texas Supreme Court issued a pivotal decision in Cactus Water Services, LLC v. COG Operating, LLC, holding that under the language of the granting clause found in the standard oil and gas lease, produced water is the property of the mineral lessee, and not the surface owner, unless the lease expressly provides otherwise.
