How to Get a Lease Done With a Coveted Anchor Restauranteur… Without Giving Everything Away

During her roundtable, Houston senior counsel Tiana DeLeo Dunn presented a hypothetical negotiation between a hot Houston restauranteur and a large retail developer/landlord for the lease of a 7,000-square-foot space in a 250,000 square-foot shopping center. The restauranteur has opened and currently operates four concept restaurants and is working to open three more with differing concepts within the year. Tiana walked through the deal terms and how both parties can form a solid partnership that could last for the next 20 years.

She regularly handles acquisition, construction, and permanent financing for shopping centers, office projects, and multi-property deals. Redefining Gross Sales as Omnichannel Retailing Takes Hold

Michael KuhnWith the rise of e-commerce platforms and COVID-19, Houston partner Michael K. Kuhn shared how landlords and tenants have turned to using percentage rent to fulfill rental obligations. During this presentation, Michael covered best practices for drafting percentage rent provisions, omnichannel categories to consider (i.e., click and collect purchases, ship-from-store sales, and ordering in-store for home delivery), and examples of online-related inclusions, exclusions, and deductions.

Michael is a board-certified commercial real estate attorney with a particular emphasis on office and retail leasing. Over his 42-year career, Michael has handled the office leasing for as many as six Class “A” downtown office buildings in Houston, Texas. Currently, he does the leasing work for two of the Houston area’s premier shopping districts. His practice is not limited to either Houston or Texas, and he routinely handles office and retail leasing matters throughout the country.
