Biography
Jennifer Caughey is a former Justice on Texas’s First Court of Appeals and current chair of Jackson Walker’s appellate section. Justice Caughey leverages her diverse experience on both sides of the bench to litigate complex cases at the appellate and trial levels.
Justice Caughey represents clients in complex matters in state and federal courts. She handles high-stakes commercial litigation, with a focus on appeals. She has particular expertise in issues involving statutory and contractual interpretation, constitutional law, healthcare, insurance, energy, administrative law, and professional liability.
She has an active and vibrant practice. Clients trust her to handle their high-stakes, bet-the-company appeals. And she does so with great success. On the state level, she represents or has successfully represented clients in major matters across Texas, including at the Texas Supreme Court, in various Texas Courts of Appeals, and in trial courts. For instance, in the past year, she won important appeals at the Texas Supreme Court concerning administrative law principles, interpretation of statutory text, and eminent domain; she also convinced the Court to progress and grant petitions on appeals that are moving through the system.
Her federal practice is equally notable. She represents or has successfully represented clients in federal courts, including handling appeals in the U.S. Court of Appeals for the First, Fifth, Sixth, Seventh, Ninth, and Tenth Circuits, as well as matters in federal district courts and at the U.S. Supreme Court. For example, she recently won major appeals in the Fifth, Ninth, and Tenth Circuits concerning diverse areas of law and hundreds of millions of dollars.
As a Justice on Texas’s First Court of Appeals, Jennifer handled a broad docket of civil and criminal appeals from Harris County and nine surrounding counties. Justice Caughey authored more than 125 opinions (half signed, half per curiam) spanning questions of civil, criminal, family, and probate law. She actively contributed to 454 cases.
Justice Caughey earned her degrees from Princeton University and Harvard Law School. After law school, she clerked for the Honorable Timothy M. Tymkovich, Chief Judge of the U.S. Court of Appeals for the Tenth Circuit, and Justice Robert J. Cordy of the Massachusetts Supreme Judicial Court.
Before serving on the bench, Justice Caughey spent years developing a sophisticated appellate and trial practice at nationally renowned litigation firms.

- Successfully appealed and overturned errant court of appeals opinion addressing critical questions of administrative law and textual interpretation. We first convinced the court to grant our Petition for Review, then prevailed in full on the merits—with a unanimous opinion issued just a few months after Jennifer’s argument. This case set critical precedent for Texas.
- Successfully represented client in high-stakes appeal to Texas Supreme Court concerning contract interpretation. Secured complete appellate victory.
- Successfully represented client at Texas Supreme Court concerning trial procedure and Covid issues. Secured victory: Court stayed trial as requested.
- Successfully represented client in Texas Supreme Court statutory-interpretation appeal of en banc Court of Appeals decision; appeal resolved favorably while pending.

- Represented client in appeal in the US Court of Appeals to the First Circuit; appeal concerns agency deference and complex federal questions.
- Fifth Circuit:
- Successfully challenged agency order on appeal to US Court of Appeals for the Fifth Circuit; agency ultimately withdrew its order in full.
- Successfully represented client in appeal to the U.S. Court of Appeals for the Fifth Circuit raising issues concerning statutory interpretation and jurisdiction.
- Currently representing client in administrative appeal involving questions of textual interpretation and deference.
- Sixth Circuit:
- Represents client on appeal concerning questions of the scope and interpretation of arbitration agreements; appeal is expected to have broad effect across industry.
- Ninth Circuit:
- Successfully represented major joint defense group in complex CERCLA appeal to the US Court of Appeals for the Ninth Circuit. Case resolved favorably while appeal was pending, on the eve of argument.
- Represents client in United States Court of Appeals for the Ninth Circuit on questions concerning procedure.
- Tenth Circuit:
- Successfully convinced U.S. Court of Appeals for the Tenth Circuit to hear permissive appeal in major $100+ million case.
- Successfully handled merits appeal of 20-year, high-stakes case, prevailing on argument that damages sought by Plaintiff were no longer available, so Plaintiff could not recover the damages sought. This appellate defense victory eliminated more than $400M in damages; it also set critical precedent.

A Jackson Walker team led by Jennifer Caughey, Brad Anderson, and Danica Milios secured a major appellate victory for the Hidalgo County Water Improvement District No. 3 in an important eminent domain and immunity dispute before the Supreme Court of Texas. The central issue was whether a land-owning governmental entity could unilaterally stop an authorized condemnation by asserting governmental immunity from suit.

The Supreme Court of Texas ruled unanimously in favor of Jackson Walker client Helena Chemical Company. In doing so, the Court reinstated a summary judgment in favor of Helena in a lawsuit alleging that an aerial application of herbicide damaged cotton fields in Mitchell County, Texas. This appeal addressed critical issues of causation and expert testimony and set important precedent.

The Supreme Court of Texas granted Jackson Walker client Hidalgo County Water Improvement District No. 3’s petition for review on an important eminent domain appeal, which addresses what happens when one condemning authority seeks to use another public entity’s land. The Court is set to hear oral argument in this case on January 12, 2023.
