Jackson Walker Secures Favorable Trademark Injunction and Global Resolution for Otiima Industries

Jackson Walker announces a significant victory on behalf of Otiima Industries, S.A., a Portugal‑based manufacturer of high‑performance, luxury window systems. Following coordinated litigation and trademark proceedings, the firm obtained preliminary injunctive relief and guided the client to a favorable resolution that preserves Otiima’s U.S. trademark rights and market position.

In the U.S. District Court for the Central District of California, Jackson Walker represented Otiima in claims arising from the termination of a long‑standing manufacturer-distributor relationship. The litigation asserted trademark infringement, unfair competition, false advertising, tortious interference, and breach of contract against former U.S. distributor Titoni Windows and Otiima USA. Otiima Industries alleged that the defendants continued using the OTIIMA trademark despite the termination of their relationship and resulting loss of any license to use the mark, which led to customer confusion and raised core questions of trademark ownership between a foreign manufacturer and its former U.S. distributor. After oral argument by Devanshi Somaya, the court granted a preliminary injunction restraining the defendants from using the OTIIMA trademark in the United States.

In parallel, Jackson Walker also defended Otiima before the Trademark Trial and Appeal Board, successfully countering a cancellation proceeding brought by the former distributor against Otiima’s U.S. trademark registrations. This dual‑forum strategy provided comprehensive IP protection and positioned the client to reach a global resolution.

As a result of Jackson Walker’s coordinated advocacy across federal court and administrative proceedings, Otiima Industries was able to settle the dispute on favorable terms, fully preserving its U.S. trademark registrations and its exclusive right to use the OTIIMA mark in the United States.
