Biography

Jose Villarreal is an intellectual property litigator and counselor focusing on IP technology disputes. A seasoned patent litigation and trial attorney, Jose represents clients in high-stakes disputes while also providing practical guidance on strategic portfolio development, licensing, intellectual property transactions, AI governance, and intellectual property issues arising in mergers and acquisitions.

Jose’s practice spans a wide range of complex technologies, including semiconductor manufacturing and circuits, diagnostic devices, networking and communications, software as a service (SaaS), customer relationship management (CRM) platforms, artificial intelligence, 3D printing, video games, and autonomous vehicles. His technical fluency and litigation experience enable him to translate sophisticated innovations into clear, persuasive strategies for clients and decision-makers.

Beyond his client work, Jose is active in the Texas intellectual property community. Since 2014, he has served on the Conference Planning Committee of the University of Texas School of Law Advanced Patent Law Institute. He is also a founding member of the Yeakel IP Inn of Court, led by the Honorable Lee Yeakel and involving judges from the Western District of Texas and members of the intellectual property bar.

  • Invalidated all patents asserted against a major software company in the U.S. District Court for the Western District of Texas.
  • Secured final judgment for a leading CRMsoftware company in patent infringement litigation in the U.S. District Court for the Northern District of California and successfully defended the judgment on appeal before the Federal Circuit.
  • Served as lead counsel for nine defendants–including major software, media, computer, financial services, and social media companies–in patent litigation involving parallel proceedings before the PTAB, the Eastern District of Texas, and the Federal Circuit. Obtained a precedential Federal Circuit reversal of the district court’s denial of a stay pending Covered Business Method review; the PTAB later held every asserted claim unpatentable, and all claims against the defendants were dismissed with prejudice.
  • Represented a leadingsoftware company in educational software patent litigation. Successfully advanced claim construction arguments involving functional claiming, contributing to a precedential Federal Circuit decision interpreting 35 U.S.C. § 112 means-plus-function claims and resulting in dismissal of the asserted claims with prejudice.
  • Represented an orthodontics software company in patent litigation involving orthodontic systems and computer-aided design. Asserted counterclaims and affirmative defenses that helped position the case for a favorable settlement.
