In discussing a lawsuit brought by the Commonwealth of Pennsylvania against an AI company, Cheryl explained that certain chatbot designs can create legal exposure when they blur the line between simulation and real-world medical advice.

The character.ai bot “is known for creating fictional, role-playing characters,” Cheryl said. “As a result, the ‘doctor’ chatbot may be viewed as a fictional character for conversation purposes. But the Pennsylvania Medical Board determined that the line between fiction and reality was crossed, resulting in the unlawful practice of medicine.”

Additionally, the publication notes that risk exposure may increase as healthcare providers adopt AI tools for clinical and operational functions, including patient triage, medical record management, and virtual assistance.
