Biography

Brandon Durrett is a board-certified oil and gas attorney focused on acquisitions and dispositions, commercial industry agreements, and complex disputes over upstream and midstream oil and gas assets.

A&D Transactions

Brandon offers broad experience negotiating purchase and sale agreements for both upstream and midstream assets. He also advises on related marketing, financing, confidentiality, escrow, due diligence, and transition matters, including purchase and sale of large producing properties, proven undeveloped reserves (PUD) acreage, non-operated leasehold positions, mineral and royalty packages, pipeline gathering systems, and saltwater disposal (SWD) facilities.

Commercial Petroleum Agreements

Brandon negotiates complex petroleum industry agreements, including “DrillCo” and participation agreements, joint ventures, joint operating agreements (JOAs), master service agreements (MSAs), drilling contracts, gathering and production sales contracts, oil and gas leases, pooling and production sharing agreements, and surface use agreements. He also handles all varieties of custom contracts and conveyances.

Oil and Gas Disputes

Brandon advises clients in oil and gas disputes involving lease termination claims, retained acreage, royalty payments, land and mineral title, deed and contract construction, pooling and allocation errors, land use and damages, payout and non-consent issues, subsurface trespass, mineral cotenancy, operatorship disputes, consent and preferential rights, breach of representations and warranties, and indemnification claims.

Regulatory Compliance Matters

A licensed attorney in Texas and New Mexico, Brandon assists petroleum industry clients in regulatory compliance matters before the Railroad Commission of Texas, New Mexico Oil Conservation Division, and Bureau of Land Management regarding drilling permit protests, spacing and density issues, assignment of allowables, injection and disposal permits, enforcement actions, forced pooling, and management of state and federal leases.

Brandon is Board Certified in Oil, Gas, and Mineral Law by the Texas Board of Legal Specialization. He regularly speaks on and writes about oil and gas deals, disputes, and cases. Prior to Jackson Walker, Brandon practiced in the Corporate Finance Practice at a national law firm.
