Last year, in TC Heartland LLC v. Kraft Foods Group Brands LLC, the U.S. Supreme Court placed tighter restrictions on where patent owners can file infringement lawsuits. A year after that decision, Houston partner Wasif Qureshi spoke with Law360 about the impact TC Heartland has had on Jackson Walker’s patent litigation practice.

Indeed, Wasif stated that his team is as busy—if not more—now than before TC Heartland.

Before the decision, the Eastern District of Texas (EDTX) was a hot spot for patent litigation, receiving about a third of the nation’s new patent lawsuits. With more restrictive venue requirements imposed by TC Heartland, filings dwindled from 605 in the quarter leading up to the decision to 127 in the first quarter of 2018. With fewer cases being filed in EDTX, Jackson Walker’s patent litigation attorneys have deepened the Firm’s work outside the district to include other Texas districts, Massachusetts, Illinois, California, and Delaware.
