Last year, in TC Heartland LLC v. Kraft Foods Group Brands LLC, the U.S. Supreme Court placed tighter restrictions on where patent owners can file infringement lawsuits. A year after that decision, Houston partner Wasif Qureshi spoke with Law360 about the impact TC Heartland has had on Jackson Walker’s patent litigation practice.
|“While we were concerned about the impact of TC Heartland on the number of cases we’d be working on, what I’ve found is it has forced us to branch out.”|
“While we were concerned about the impact of TC Heartland on the number of cases we’d be working on, what I’ve found is it has forced us to branch out,” Wasif said.
Indeed, Wasif stated that his team is as busy—if not more—now than before TC Heartland.
Before the decision, the Eastern District of Texas (EDTX) was a hot spot for patent litigation, receiving about a third of the nation’s new patent lawsuits. With more restrictive venue requirements imposed by TC Heartland, filings dwindled from 605 in the quarter leading up to the decision to 127 in the first quarter of 2018. With fewer cases being filed in EDTX, Jackson Walker’s patent litigation attorneys have deepened the Firm’s work outside the district to include other Texas districts, Massachusetts, Illinois, California, and Delaware.
In the article, Wasif also noted that as a Texas-based firm, Jackson Walker is able to offer lower rates while providing sophisticated counsel gained in part from years of practice in one of the nation’s busiest patent litigation districts. Moreover, Wasif and his patent litigation colleagues at Jackson Walker have decades of IP experience from previously working in well-known national firms.
