Biography

Brett handles a wide variety of digital infrastructure real estate matters, including the acquisition, disposition and development of data centers and telecommunication sites. As part of this practice, he has experience preparing and negotiating purchase and sale agreements, development agreements, project governance documents (e.g., condominium regimes and declarations of covenants, conditions, and restrictions), electrical easements, various telecommunication agreements, and other digital infrastructure project documents. Brett understands the nuances of digital infrastructure and works to achieve his client’s goals by maintaining a practical, yet creative, approach.

Data Centers Practice Experience

• Represented a leading data center developer in the acquisition and development of a data center campus, including the acquisition of the subject property, the development of same and the strategies to structure the foregoing to maximize value and adhere to local and statewide regulations.
• Assisted in the representation of a leading data center developer concerning various land use matters, including providing counsel and advice with zoning, entitlement processes, and compliance with local and state regulations.
• Represented a variety of sellers with the sale of raw land to data center developers, including the preparation of such land for maximum value, retaining certain land for future data center development sales, and the actual sale of such land.

Telecommunications/Connectivity Practice Experience

• Represented numerous institutional property owners in the negotiation of various telecommunication projects, including fiber agreements, cell tower leases, DAS (Distributed Antenna System) agreements, rooftop telecommunication licenses and cabling agreements.
