Jackson Walker played a significant role in a definitive defense victory in the Winter Storm Uri multidistrict litigation (MDL), one of the largest and most complex mass‑tort proceedings ever brought in Texas. On March 27, 2026, the Texas Supreme Court denied all mandamus petitions challenging the First Court of Appeals’ conclusive decision, in which Jackson Walker also was instrumental, ordering dismissal of all remaining claims against the hundreds of power generators in the Winter Storm Uri MDL.
The ruling brings the power generator cases to a close and represents a major step toward the resolution of the broader MDL, which encompasses over 200 lawsuits with more than 30,000 individual plaintiffs, two putative class actions, and over 1,500 insurance companies bringing subrogation claims for over 250,000 policyholders against more than 500 defendants, including nearly all power generators, almost every natural gas pipeline or producer operating in Texas, and other key participants in the Texas power market. All told, these personal injury and property damage plaintiffs sought more than a billion dollars in damages caused by Winter Storm Uri in Texas.
From the outset, Jackson Walker has been central in the joint defense effort, helping to establish the MDL and then develop and execute a cohesive, uniform strategy among competitors – both clients and law firms – working together at unprecedented scale. The defense successfully obtained stays of the cases, limited proceedings to pre‑discovery bellwether motions, avoided costly discovery, maintained solidarity across defendants and industry groups, and secured dismissal of key claims, culminating in this decisive appellate victory.
Jackson Walker represented multiple power generator defendants in the MDL, including Constellation Energy, Olin Corporation, CPS Energy, and the City of Austin (Austin Energy).
