Biography
Marc Fuller is a partner in Jackson Walker’s Trial & Appellate Litigation group, where he represents publishers, internet companies, and other businesses in a variety of commercial disputes.
Marc’s media and entertainment litigation experience includes defamation, privacy, copyright, and other disputes over content and newsgathering. He has extensive experience representing technology companies and online services in disputes over content moderation, user anonymity, and digital privacy. Marc has also handled a broad range of litigation for nonmedia companies, focusing on appeals, class actions, disparagement claims, and First Amendment matters. He has authored amicus briefs in media and First Amendment cases in the Texas Supreme Court, Fifth Circuit, and U.S. Supreme Court.
Following law school, Marc served as a judicial clerk to Judge Sidney A. Fitzwater, U.S. District Court for the Northern District of Texas, and to Judge Fortunato P. Benavides, U.S. Court of Appeals for the Fifth Circuit.

- Tex. Dist. (2023) – Obtained dismissal of defamation and fraud claims against publisher and authors over reporting in prize-winning book on controversy surrounding a popular singer’s collection of Alamo-related artifacts

- 5th Cir.; N.D. Tex. (2021) – Assisted in defense of internet company, securing dismissal of Anti-Terrorism Act claims arising out of a mass shooting in Dallas, Texas and affirmance on appeal
- Tex. Dist. (2020) – Secured dismissal of claims against internet security company arising out of a mass shooting in El Paso, Texas
- Tex. App. (2015) – Obtained an appellate victory for multinational e-commerce company against multi-level marketing companies seeking to unmask anonymous online auction sellers
- S.D. Miss. (2014) – Secured dismissal of claims brought against multinational e-commerce company based on the sale of allegedly defective hunting equipment

Marc Fuller and Maggie Burreson filed an amicus brief challenging Llano County’s decision to remove books on race and LGBTQ topics from public library shelves. The amicus group includes the American Association of Publishers; the five largest book publishing companies in the U.S. – Penguin Random House, Simon & Schuster, HarperCollins Publishers, Hachette Book Group, and Macmillan Publishers; independent book publisher Candlewick Press; and Scholastic, Inc., the largest publisher of children’s books.

In the space of a three-page per curiam opinion, Gonzalez v. Google went from blockbuster to nothingburger. The first (and, therefore, the biggest) Section 230 case to be considered on the merits by the U.S. Supreme Court, Gonzalez was widely billed as the case that could break the internet, garnering headlines and attracting armies of amici on both sides.
