Biography
Marc Fuller is a partner in Jackson Walker’s Trial & Appellate Litigation group, where he represents publishers, internet companies, and other businesses in a variety of commercial disputes.
Marc’s media litigation experience includes defamation, privacy, copyright, and other disputes over content and newsgathering. He has extensive experience representing technology companies and online services in disputes over content moderation, user anonymity, and digital privacy. Marc has also handled a broad range of litigation for nonmedia companies, focusing on appeals, class actions, and First Amendment matters. He has authored amicus briefs in media and First Amendment cases in the Texas Supreme Court, Fifth Circuit, and U.S. Supreme Court.
Following law school, Marc served as a judicial clerk to The Honorable Sidney A. Fitzwater, U.S. District Court for the Northern District of Texas, and to The Honorable Fortunato P. Benavides, U.S. Court of Appeals for the Fifth Circuit.

- 5th Cir.; S.D. Tex. (2022) – Obtained dismissal of defamation claims against website based on lack of personal jurisdiction and secured affirmance of dismissal order
- W.D. Tex. (2022) – Obtained dismissal of negligence and conspiracy claims against a television network that aired documentary program on policing
- E.D. Tex. (2020) – Obtained dismissal of defamation claims against online publisher that reported on plaintiff’s role in promoting conspiracy theory about 2016 presidential election
- NY App. Div. (2019) – Obtained affirmance of dismissal of defamation and tortious interference claims by a hedge fund against newspaper publisher
- Tex. (2019) – Obtained dismissal under the Texas anti-SLAPP statute of defamation claims over newspaper’s coverage of healthcare fraud investigation
- 5th Cir.; E.D. Tex. (2019) – Obtained affirmance of dismissal of RICO, conspiracy, tortious interference, and defamation claims against a local newspaper, its employees, and owner
- Tex. (2016) – Represented national broadcaster in defamation case brought by a neurosurgeon based on an investigative news report
- Tex. App. (2014) – Secured dismissal of libel claims by a prominent anti-vaccine activist against a U.K.-based medical journal and an award-winning investigative reporter
Internet Litigation
- 5th Cir.; N.D. Tex. (2021) – Assisted in defense of internet company, securing dismissal of Anti-Terrorism Act claims arising out of a mass shooting in Dallas, Texas and affirmance on appeal
- Tex. Dist. (2020) – Secured dismissal of claims against internet security company arising out of a mass shooting in El Paso, Texas
- Tex. App. (2015) – Obtained an appellate victory for an e-commerce company against multi-level marketing companies seeking to unmask anonymous online auction sellers
- S.D. Miss. (2014) – Secured dismissal of claims brought against an e-commerce company based on the sale of allegedly defective hunting equipment
- Tex. Dist. (2014) – Secured dismissal of various claims against an Internet service provider brought by an individual who was allegedly assaulted by someone she met online
Commercial Litigation
- 11th Cir. (2022) – Secured dismissal of Coal Act claims against manufacturer in appeal from bankruptcy proceeding
- Represented various businesses in defamation and disparagement actions by former executives
Insurance Litigation
- Represented auto insurer in numerous class actions challenging medical bill review practices
- Represented stop-loss insurer in a dispute with an employer health plan and a third-party plan administrator
